Terms of Sevice
The following terms and conditions (the “Terms”) govern your access to, and use of, StoryTEQ’s cloud-based video creation, rendering and management platform and all related code, documentation, features, and services (collectively, “StoryTEQ’s service“). Therefore, please read these Terms carefully since they set out the legal rights and obligations between you and StoryTEQ B.V. (“StoryTEQ“, “we“, “our” or “us“).
By accessing, utilizing or using any part of the StoryTEQ platform, dashboard and/or any StoryTEQ’s related service, you, and any entity you represent, acknowledge that you have reviewed, and you agree to be bound by these terms. If you do not agree to these terms, you may not access or use any part of the StoryTEQ’s service.
1. Acceptance of these Terms
We make the StoryTEQ’s service available under these Terms to our customers (“Customers“, “you”, or “your”) who have entered into an
agreement with us by accepting a service or proposal from us in any form. The StoryTEQ’s service may be used for the rendering, creation, generation, delivery and optimization of audiovisual works (mainly “Videos“) through our proprietary video platform.
2. Modifications to the Terms
StoryTEQ reserves the right to change or modify the Terms from time to time. Posting the modified Terms on our website:
www.StoryTEQ.com will give effect to the revised terms. Your continued use of the StoryTEQ service indicates Your acceptance of any revised terms. If You do not agree to the revised terms, please refrain from using StoryTEQ’s services.
Your access to and use of the StoryTEQ’s service is provided at no additional charge to you under these Terms, but is expressly subject to your continued and timely payment in full of all applicable fees, taxes and other charges, as set forth in your Agreement with StoryTEQ. In any case of non-payment and/or untimely payment and/or incomplete payment, StoryTEQ has the right to
(temporarily) suspend your right to the StoryTEQ’s services.
4 Access and Restrictions
Subject to your compliance with these Terms, after an agreement, StoryTEQ grants you a limited, revocable, non-exclusive, nonsublicensable, and non-transferable right of use of StoryTEQ’s service. As a condition to the foregoing you agree not (and shall not allow any third party) to:
- 4.1 copy, distribute, rent, lease, lend, use for timesharing, commercially host, export,
modify, adapt, translate, enhance, customize, or otherwise create derivative works
of, the StoryTEQ’s service or any part thereof;
- 4.2 reverse engineer, decompile, disassemble, or otherwise attempt to derive the source
code of, the StoryTEQ’s service or any part thereof, except as expressly permitted by
the law in effect in the jurisdiction in which you are located;
- 4.3 remove or modify any proprietary notices, labels or legends on or in the StoryTEQ’s
- 4.4 (try to) disable any security or technological features of the StoryTEQ’s service;
- 4.5 use, post, transmit or introduce any device, code, routine or other item (including
without limitation bots, viruses, worms, and Trojan horses) that interferes (or
attempts to interfere) with the operation or integrity of the StoryTEQ’s service;
- 4.6 use the StoryTEQ’s service to design or develop any product or service that
competes with the StoryTEQ’s service or the business of StoryTEQ, or use the
StoryTEQ’s service for any unlawful or fraudulent purpose, to breach these Terms, or
to infringe or misappropriate any third party intellectual property, privacy, or
- 4.7 take any action that imposes or may impose, as determined in StoryTEQ’s sole
discretion, a disproportionately large load on the StoryTEQ’s service infrastructure;
- 4.8 publicly disclose the results of any StoryTEQ’s service benchmark (or similar
comparison) test, without the express prior written approval of StoryTEQ;
- 4.9 use the StoryTEQ’s service in a manner inconsistent with its then-current
StoryTEQ has put in place physical, electronic, and organizational procedures according to industry best practices to safeguard and secure the information (Data) we collect, receive and/or process through or/and with StoryTEQ’s services.
More information about our data policy here. The StoryTEQ data policy is an inherent part of these Terms and your Agreement with StoryTEQ.
- 6.1 As you use our Services, you (or we for you) may import (manually or automatically)
into our system, personal information you have collected from your users /
customers or other individuals. We have no direct relationship with these users /
customers or any person other than you, and for that reason, you are responsible
for making sure you have the appropriate permission for us to collect and process
information about those individuals.
The StoryTEQ’s service may include tools giving you the opportunity to provide us with feedback data (such as, but not limited to, comments, suggestions, and questions) about the StoryTEQ’s service (“Feedback“). You agree that all rights, title and interest in and to all Feedback (even if provided to us other than through the StoryTEQ’s service tools) are and shall remain the sole and exclusive property of
8 Support & Service Level Agreement
In conjunction with any technical support and extended support to which you may be entitled under your Agreement, StoryTEQ provides email and telephone support (under working hours) for your use of the StoryTEQ’s service under these Terms.

- 9.1 General. All rights regarding the StoryTEQ platform and the StoryTEQ services, not
expressly granted under these Terms are hereby reserved by StoryTEQ. In addition,
the rights granted by StoryTEQ to you under these Terms shall terminate
immediately upon the earlier of the termination of these Terms (as described in
Section 16 below) or your breach of any provision of these Terms.
- 9.2 StoryTEQ’s service. All rights, title and interest in and to the StoryTEQ’s service and
its features (such as, but not limited to, graphics and interface), including all
reproductions, corrections, modifications, customizations, enhancements and
improvements thereof, as well as all related patent rights, copyrights, trade secrets,
trademarks, service marks, goodwill, and intellectual property rights, are and shall
remain the sole and exclusive property of StoryTEQ and/or its licensors.
Both StoryTEQ and you may have access to certain non-public and/or proprietary information of the other, in any form or media, including
without limitation trade secrets, technical data, technology, know-how, software codes and designs, price lists, and developments (“Confidential Information“). You acknowledge and agree that the StoryTEQ’s service is or contains Confidential Information of StoryTEQ. Each party shall take measures at least as protective, but in no event less than a reasonable standard, as those taken to protect its own
Confidential Information, to safeguard the Confidential Information of the other party from unauthorized disclosure and use.
You may only use our Confidential Information to the extent explicitly granted under these Terms (if any), and you may only disclose our Confidential Information to your employees who have a need to know such Confidential Information and who are subject to written confidentiality undertakings at least as protective of our Confidential Information as set forth herein. All right, title and interest in and to Confidential Information are and shall remain the sole and exclusive property of the party disclosing it hereunder.
In the event that either you or we (the “Recipient“) are required by law, regulation, judicial order or other administrative or legal requirement to disclose the disclosing party’s (the “Discloser“) Confidential Information, the Recipient agrees to notify the Discloser immediately in writing, unless otherwise prohibited by such law, regulation, order or requirement. Upon termination of these Terms (as described in paragraph 13), each party shall promptly return or destroy all Confidential Information of the other party and, upon request, certify same in writing.
11 Compliance with Laws
You agree to comply with all applicable international, national, state, regional and local laws and regulations in accessing and/or using the
StoryTEQ’s service (or any part thereof) and in performing your obligations and exercising your rights under these Terms, including without limitation laws relating to privacy, data protection, and exports.
12 Representations and Warranties
You hereby represent and warrant that (a) you possess and shall maintain all rights, licenses and consents required to license to
StoryTEQ the Consumer Data and Video Files, Interfaces & Templates and that such license does not infringe or misappropriate the intellectual property, privacy, and/or publicity rights of any third party; (b) you possess and shall maintain all governmental and administrative licenses, permits and approvals necessary to use the StoryTEQ’s service and to perform your obligations and exercise your rights under these Terms; and (c) all Video Files, Interfaces & Templates will (i) be free from any viruses, Trojan horses, worms, or other malicious code or items, (ii) not contain obscene language, pornography (or other adult-only content), defamatory,
racist or similar content, (iii) not constitute a tort against any third party, and/or (iv) not infringe or misappropriate the intellectual, privacy or publicity rights of any third party.
StoryTEQ hereby represents and warrants that (a) the StoryTEQ service does not infringe or misappropriate the intellectual property, privacy, and/or publicity rights of any third party; (b) it possess and shall maintain all governmental and administrative licenses, permits and approvals necessary to perform its obligations and exercise its rights under these Terms; and (c) the StoryTEQ service will (i) be free from any viruses, Trojan horses, worms, or other malicious code or items, (ii) not contain obscene language, pornography (or other adult-only content), defamatory, racist or similar content, (iii) not constitute a tort against any third party, and/or (iv) not infringe or misappropriate the intellectual, privacy or publicity rights of any third party.
You acknowledge and agree that when you are in violation of these Terms, StoryTEQ can, at any time, and without notice to you: (a) discontinue or modify any aspect of the StoryTEQ’s service; and/or (b) suspend or terminate your, or general, access to the StoryTEQ’s service (or any part thereof), and in such an event StoryTEQ shall not be liable to you or any third party for any loss, damage, or
injury resulting or arising therefrom. Our termination of your, or general, access to, the StoryTEQ’s service shall constitute our termination of the Terms, and any Account you may have shall become cancelled upon such termination.
14 Disclaimer of Warranties
- 14.1 You assume all responsibility for the selection of the StoryTEQ’s service to achieve
your intended results. You also acknowledge and agree that the below exclusions
and disclaimers are an essential part of these Terms. Applicable law may not allow
the exclusion of certain warranties, so to that extent such exclusions may not apply.
References below to the “StoryTEQ’s Service” include the StoryTEQ’s service as a
whole as well as each part thereof.
- 14.2 The StoryTEQ’s service is provided on an “as is” and “as available” basis, and you
acknowledge that there are no representations, warranties or claims of any kind
made by StoryTEQ with respect to the StoryTEQ’s service, whether express, implied
or statutory, including without limitation warranties of quality, performance,
merchantability, fitness for a particular purpose, non-infringement, and title, or
otherwise arising from a course of dealing or usage of trade.
- 14.3 StoryTEQ does not warrant that the StoryTEQ’s service will operate uninterrupted,
error free, according to your needs, or that defects will be corrected. StoryTEQ does
not offer a warranty or make any representation or claim regarding any content,
materials, information, or results that you create or obtain through the StoryTEQ’s
service (such as the likelihood of increasing consumer retention, engagement or
revenues). Your use of, and reliance upon, the StoryTEQ‘s service, is entirely at your
sole discretion and risk, and StoryTEQ shall have no responsibility or liability
whatsoever to you in connection with any of the foregoing. That being stated,
StoryTEQ will try it’s upmost to ensure uninterrupted, error free access to the
- 14.4 You agree that StoryTEQ will not be held responsible or liable for any consequences
to you or any third party that may result from technical problems of the internet,
slow connections, system failure, outages, traffic congestion, overload of our or
other servers, or other events beyond StoryTEQ’s reasonable control.
15 Limitation of liability
Notwithstanding any other provision in these terms, and to the fullest extent permitted by applicable law:
- 15.1 StoryTEQ will not be liable to you or any third party for any indirect, consequential,
incidental, punitive or special damages of any kind, or for your, or any third parties,
loss of profits, revenues, business opportunity, or data, arising out of these terms or
in connection with the use of, or inability to use, the StoryTEQ’s service (or any part
thereof), whether based on a claim or action in contract, tort (including negligence)
strict liability, breach of statutory duty, or otherwise, even if StoryTEQ has been
advised of the possibility of such damages, and even if direct damages do not satisfy
- 15.2 StoryTEQ’s aggregate liability to you or any third party for any loss and/or damages
under these terms or in connection with the use of, or inability to use, the
StoryTEQ’s service (or any part thereof), shall not exceed the total amount of fees
paid by you to StoryTEQ (if any) hereunder in the twelve (12) months prior to brining
You agree to indemnify and hold harmless StoryTEQ and its subsidiaries, its affiliates, officers, directors and employees, from and against any and all liability, losses, claims, damages and expenses, including but not limited to reasonable attorney’s fees and costs of litigation, related to Your breach of these Terms, or to any Content You submit or post, or to Your use of the Platform, or to Your violation of any rights of a third party.
You agree that StoryTEQ may use your company logo on StoryTEQ’s customer list and website to disclose that you are a licensee and customer of StoryTEQ. In addition, you agree that StoryTEQ may use your use of the StoryTEQ service in the form of Video on their case page on the website. If you don’t want to have your case or campaign made public, you should inform StoryTEQ of this.
- 18.1 Relationship. The relationship between you and StoryTEQ is solely that of
independent contractors. Nothing in these Terms shall be construed to create a
partnership, joint venture, employment or agency relationship.
- 18.2 Governing Law. These Terms shall be governed by, and construed in accordance
with, the laws of the Netherlands, without regard to their conflicts of law rules and
- 18.3 Jurisdiction and Venue. You agree that any action, proceeding, controversy or claim
(each, a “Dispute“) under or arising out of these Terms, between you and StoryTEQ,
shall be brought and resolved only in the courts located in the Netherlands, and you
hereby irrevocably submit to the personal jurisdiction and venue of such courts with
respect to a Dispute. Notwithstanding the foregoing, equitable relief may be sought
in any court of competent jurisdiction.
- 18.4 Severability. In the event any provision of these Terms is ruled to be invalid, illegal
or unenforceable, the validity, legality and enforceability of the remaining provisions
shall not in any way be affected or impaired, and a valid, legal and enforceable
provision of similar legal intent and economic impact shall be substituted therefor.
Service Level Agreement
1 Service Level Agreement (SLA)
We understand that service interruptions of our platform can have an effect on your customer contact and your business. We’ve set a high bar for service uptime because we believe that you should be able to depend on StoryTEQ to add value to your company.
2 The Basics
- We guarantee a 99.5% monthly uptime.
- We’ve designed our SLA to be simple and transparent.
- If we fall short of our 99.5% uptime guarantee, we’ll refund customers the monthly license fee of the month in which we fall short.
3 The Details
Service Level Agreements can be chock-full of terminology that is difficult to decipher. We’d like to take the opportunity to explain, in real words, what the details of our SLA are.
To fairly assess the overall magnitude of downtime for everyone using StoryTEQ, “Downtime” is based on two factors: 1) the number of minutes StoryTEQ was unavailable, and 2) the percentage of StoryTEQ customers that were affected.
We use server monitoring software to monitor when StoryTEQ is down — specifically, measuring the server side error rate, looking at results from ping tests, web server tests, TCP port tests, and website tests.
At the end of each month, every individual downtime is added together to give us the entire month’s “Downtime Period.”
Note: Calculating downtime can be a complicated exercise, so we aim to keep it as simple and transparent as possible by tying our SLA guarantee to a single monthly uptime number. Downtime doesn’t affect everyone at the same time or in the same way. StoryTEQ could be experiencing an outage, but your campaign or application may be completely unaffected, and vice versa.
Here are some scenarios that will not be counted towards downtime:
- Slowness with specific features (such as render time, page load time, etc.)
- Issues related to external apps or caused by third parties specific to your StoryTEQ usage.
- Delays with API calls or form submits.
- Network problems external to our systems which are beyond our control, such as bad routing tables between your ISP and our servers.
- “Scheduled Downtime” to complete maintenance.
“Monthly Uptime” is the percentage of total possible minutes StoryTEQ was available to you. To calculate this, we subtract the number of downtime minutes from the total possible minutes in a given month.
6 Scheduled Downtime
Occasionally, we need to perform maintenance to keep StoryTEQ working as smoothly as possible. If scheduled downtime is necessary, we’ll give you 48 hours advance notice. In a calendar year, there will not be more than 10 hours of scheduled downtime.
7 Service Credit
If we miss our 99.5% uptime guarantee, we’ll refund you the monthly fee of the particular month that StoryTEQ was down to you according to the above mentioned terms.
8 A Note About Performance Issues
StoryTEQ’s SLA excludes performance issues:
- Caused by factors outside StoryTEQ’s reasonable control
- That resulted from any actions or inactions of you or any third party
- That resulted from your equipment and/or third party equipment (not within the primary control of StoryTEQ)
- Arising from our suspension and termination of your right to use StoryTEQ in accordance with the StoryTEQ Terms of Service
That being said, happy customers are our main priority. So if you are experiencing any performance issues, do let us know, so we can resolve them asap.
9 Security Issues
Security issues are a different beast altogether. We try our utmost to protect our systems and your data. More about out data policy can be found here. Whenever there is a security issue (..), we’ll notify you as soon as possible but in any case within 2 working hours after the issue. We’ll tell you what happened and what we’ve done to mediate the issue and/or going to do. We’ll also give a classification to the issue, namely:
- Priority 1: High Security / Vulnerability risks, e.g. software vulnerabilities that have been discovered and exploited or published, unauthorized breaches of (part of) the system containing core functionality or access to data, unauthorized access to personal data
- Priority 2: Medium Security / Vulnerability risks, e.g. software vulnerabilities that have been discovered and attempted to be exploited, unauthorized breaches of non core parts of the system
- Priority 3: Low Security / Vulnerability risk, e.g. access of known users to data beyond their permissions
Per classification, the response time is:
Prio 1: asap but not longer than 1 hour, Prio 2: asap but no longer than 2 hours, Prio 3: asap but not longer than 4 hours (note: 08:00-24:00)
The recovery time is:
- Priority 1: asap but not longer than 2 hours
- Priority 2: asap but no longer than 4 hours
- Priority 3: asap but not longer than 12 hours
- Note: our operating hours are 08:00-24:00 CET
The recovery point objective is always the nearest point of a full working un-breached version of the system which contains the most recent data.We run incremental backups 6x per day and full backups 1x per day.
If you have any additional agreements with us as part of your Agreement with us, we’ll adhere to those additional agreements in addition to the above mentioned actions
The following terms and conditions (the “Terms”) govern the way StoryTEQ processes, stores and secures data. Therefore, please read these Terms carefully since they set out the rights and obligations between you and StoryTEQ B.V.
(“StoryTEQ“, “we“, “our” or “us“) concerning your and our data.
Data security. StoryTEQ has put in place commercially reasonable physical, electronic, and organizational procedures to safeguard and secure the information (Data) we collect, receive and/or process through or/and with StoryTEQ’s services. More explicitly, but not limited by:
- All the connections and applications (including login pages) on our end are TLS encrypted.
- StoryTEQ’s account passwords and API access tokens are hashed. The stored data can only be accessed by using hashed access tokens.
- Our, and thus your Data, is stored on Google Cloud servers (and thus subject to Google Cloud’s security measures). Google Cloud is certified with ISO27001, ISO27017, ISO27018 https://cloud.google.com/security/compliance. The physical location is in St. Ghislain, Belgium.
- StoryTEQ’s databases are only accessible from authorized IP addresses, in combination with a hashed access token. All data at rest is encrypted.
- Data stored in StoryTEQ databases is separated per client with a unique CompanyID. An access token has only access to data from a specific CompanyID and thus can never access any other data.
- All our data has a life-time value and will be deleted after the life-time expires.
- Our domains and sFTP servers are hosted by TransIP. TransIP and therefor the domains and sFTP folders are certified with ISO 9001, ISO 27001, ISO 14001, NEN 7510, PCI DDS. The location of the servers is Amsterdam, the Netherlands.
- Generated Videos are only available through hashed URL’s, therefor it is not possible to randomly gain access to another person’s unique Video.
- We run regular, automated, back-ups of our system and databases (both full and incremental back-ups).
- We run daily automated scripts on our API & database for security checks and do a monthly security analysis to ensure our security is up to date.
- Our API runs on a flexible hosting environment with a fail-over cluster with constant health checks.
- We educate our (technical) personnel on how to treat personal data on a continuing basis, but at least in monthly, recurring, sessions.
2 License to Data
As a Customer, as long as you make use of the StoryTEQ service, you grant StoryTEQ a royalty-free, paid-up, non-exclusive, irrevocable and worldwide license to access, log, retain and use all (Consumer) Data and Video files pertaining to your account, as well as all other data and content you provide to us, to: administer and make improvements to the StoryTEQ’s service, as well as carry out Customer related tasks, ie; billing; generation and the delivery of Video’s; collection and analyzing Consumer Data; and compile statistics, metrics, insights, and general trend-data about the StoryTEQ’s service for your insight. While doing this, StoryTEQ will always adhere to the agreements made between you and StoryTEQ about the handling of (Consumer) Data.
For clarity, as between you and StoryTEQ, all Consumer Data and Video files and templates shall be solely and exclusively owned by you. As used herein, Consumer Data means any data pertaining to Consumers’ engagement with Video’s (such as, without limitation, click-to-play events, percentage of Video’s viewed, and click-through rates).
- As you use our Services, you (or we for you) may import (manually or automatically) into our system, personal information you have collected from your users / customers or other individuals. We have no direct relationship with these users / customers or any person other than you, and for that reason, you are responsible for making sure you have the appropriate permission for us to collect and process information about those individuals.
The StoryTEQ’s service may include tools giving you the opportunity to provide us with feedback data (such as, but not limited to, comments, suggestions, and questions) about the StoryTEQ’s service (“Feedback“). You agree that all rights, title and interest in and to all Feedback (even if provided to us other than through the StoryTEQ’s service tools) are and shall remain the sole and exclusive property of StoryTEQ.
5 Compliance with Laws
You agree to comply with all applicable international, national, state, regional and local laws and regulations in accessing and/or using the StoryTEQ’s service (or any part thereof) and in performing your obligations and exercising your rights under these Terms, including without limitation laws relating to privacy, data protection, and exports (such as the GDPR).

At StoryTEQ, we do everything in our power to protect your data and give you full control over your personal data on our website and on our platform. Our aim is that you always feel informed and empowered with respect to safeguarding your own privacy, and the privacy of your customers. Why and how do we use your personal data?
We only ask for personal data when we need it for business purposes or to provide you with relevant information. Whether you sign up for our newsletter or sign an agreement with us, you leave your personal data with us for a particular purpose. You always have the opportunity to explicitly agree to the collection, use, disclosure, and sharing of the information you’ve provided. That also applies when you’re browsing our website, where you can manage your cookie preferences.
Since customers integrate our products in their own applications, we don’t interact with their end users directly. When customers do share end user information with us, we always handle the data in accordance with data protection regulations, including GDPR. We don’t use that data for any purposes, other than specifically issued by the customer who provides the data.

What personal data do we collect?
Everyone who uses our services will have bits and pieces of information about them collected, stored and processed. However, we don’t collect more information than we need. On our website, we collect that data via Cookies. The cookies we use and what they collect can be reviewed here.
For what is my data being used?
We collect personal data for specific purposes, and we’ll always tell you what those are when we collect it. We’ll use the collected data for that purpose alone, as long as our relationship stays the same. If our relationship changes, we may need more information. For example, if you fill out a form to request more information, we’ll use your data to send it to you. If you then decide to become a customer, we need additional information including your billing address.
Here’s a list of the purposes we need information for.
- Sharing (hopefully) relevant information about our products and services (via our newsletter)
- Creating an account that’s connected to your person and company,
- Analyzing usage of our website, products and services,
- Detecting fraudulent or unlawful activity,
- Keeping your account secure.
You will always have the choice to provide personal data on our domain or not. Please keep in mind that declining to provide personal data might fairly mean that you cannot use a certain product or service. We will tell you the implications of not providing the information asked for when you choose not to do so.
How long do we store your personal data?
We only keep your data for as long as we need it, or are required to for legal reasons. We’ll then either delete it or anonymise it so it doesn’t identify you. We treat data differently depending on what it’s used for, but you can ask us to delete your personal data at any time.
For example, data about your visits to our website will be retained until your browsing session ends, except where it concerns data collected for the analytical and marketing purposes specified above. In those cases, we will keep your information for 1 year after collection.
Do you share information with third parties?
We share information relating to our users with selected third parties who provide us with a variety of different services that support the delivery of our services (let’s call them “Third Party Processors”). These Third Party Processors range from providers of technical infrastructure to customer service and authentication tools. We require any Third Party Processor which handles information on our behalf to do so pursuant to contractual terms which require that the information is kept secure, is processed in accordance with applicable data protection laws, and used only as we have instructed and not for that Third Party Processor’s own purposes.
We sometimes place small data files, called cookies, or other tracking technologies on your browser. A cookie is a small text file that a website saves on your computer or mobile device when you visit a website. StoryTEQ uses both session and persistent cookies. Session cookies are cookies that disappear from your computer or browser when you logout of your account or close your browser. Persistent cookies are stored even after you’ve closed the page.
